Today, President Trump released his 2026 Budget. The document states in the SBA section, “the Budget ends 15 specialized and duplicative programs, leaving only the Small Business Development Centers (SBDCs) program.”

Senate Action This Week
This week, the Senate did not pass S.Res. 49, a joint resolution terminating the national emergency declared to impose global tariffs. Senators Wyden (D), Paul (R), Kaine(D), Shaheen (D), Welch, Warren(D), and Schumer (D) co-sponsored the legislation that, if enacted, would have terminated the emergency President Trump declared and overturn the global tariffs. It would have eliminated the President’s tariffs of 10% on nearly all imported goods and ended his threat of additional tariffs up to 50% on products Americans buy from dozens of countries. This resolution was subject to a simple majority vote but failed in a 49-49 vote.
Small Business Roundtable Meeting with Speaker Mike Johnson’s Office
This week, several small business organizations, including NAWBO, met with Speaker Johnson’s Senior Policy Advisor for Tax and Trade Curt Beaulieu. Small Business Roundtable members supported many of the same tax provisions that NAWBO has advocated on the Hill. NAWBO made an additional special request for the permanency of Section 45S, which is the paid leave tax credit.
Tariff Listening Session
On Thursday, May 8, 12:00 PM – 1:00 PM ET, Senate Small Business Committee Ranking Member Markey will be holding a virtual listening session on the impact of tariffs on small businesses. Six business owners who operate or have clients in Massachusetts will join Senator Markey and share the effect of recent tariff announcements. The roundtable will be conducted on WebEx, and anyone who’d like to participate as an audience member can register for the listening session using this link.

Regulatory Update
The U.S. Department of Labor’s Wage and Hour Division today issued a field assistance bulletin (FAB) providing guidance on how to determine employee or independent contractor status when enforcing the Fair Labor Standards Act. While the department reviews the 2024 final rule, Employee or Independent Contractor Classification Under the Fair Labor Standards Act – which is also being challenged in federal court – agency investigators are directed not to apply the 2024 rule’s analysis in current enforcement matters. Instead, the division will rely on longstanding principles outlined in Fact Sheet #13 and further informed by the reinstated Opinion Letter FLSA2019-6, which addresses classification in the context of virtual marketplace platforms. This guidance does not change existing regulations but reflects how the department is allocating enforcement resources during the review of the 2024 rule. The FAB supersedes any prior or conflicting guidance provided to Wage and Hour Division staff on enforcement related to independent contractor misclassification.
